Terms of Use

Dernière mise à jour · Ce document est fourni en anglais.

These Terms of Use (“Terms”) are an agreement between you and Shubham Sharma, an individual in Canada trading as LiftClub (“LiftClub”, “we”, “us”). They cover the LiftClub iPhone app and liftclubapp.com, including the web pages that open LiftClub share links (together, the “Service”).

By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you don’t agree, don’t use the Service.

1. Who can use LiftClub

  • You must be at least 13 years old to use LiftClub.
  • Friends features (a handle, friends, the feed, posts, likes and sending workouts to friends) and LiftAI are only for people aged 18 or over.
  • We use the birthday you give us to apply these limits, so give your real one.
  • If you’re under the age of majority where you live, you may use LiftClub only with the permission of a parent or guardian, who agrees to these Terms for you.
  • You can’t use LiftClub if we have banned you, or if the law prohibits you from receiving the Service.

2. Your account

  • You sign in with a one-time code sent to your email, with Sign in with Apple, or with Sign in with Google. LiftClub has no passwords, so keep your email, Apple and Google accounts secure.
  • Give accurate information and keep it up to date. You’re responsible for what happens on your account. Tell us at [email protected] if you think someone else has used it.
  • Handles are 3 to 20 characters and must be unique. Some handles are reserved. You can change yours once every 7 days, and we hold your old handle for you for 30 days. We may remove or change a handle that breaks these Terms or the Community Guidelines, or that impersonates someone.
  • LiftClub saves your training on your iPhone first and syncs it to our servers when you’re online. Signing out leaves your training on that iPhone.

3. Health and safety

LiftClub is a training log and habit tool. It isn’t medical advice, and it doesn’t replace a doctor, physiotherapist or qualified coach.

  • Exercise carries a risk of injury. Check with a medical professional before you start a new program, especially if you have a health condition, are pregnant or are recovering from an injury.
  • Stop if something hurts.
  • Exercise demonstrations, instructions, workouts, programs and LiftAI suggestions are general information. You decide what’s right for your body, including what weight to lift.
  • The Injured, Recovering and On Vacation statuses only pause your streak. They don’t track or assess your health.

4. Streaks and fair play

  • A day counts toward your streak only when your in-app workout timer sessions that day add up to at least 20 minutes. A single session can’t be longer than 4 hours.
  • Shields, statuses and scheduled rest days work as described in the app. We may adjust how they work to keep streaks fair.
  • Streaks, shields and stats have no monetary value and can’t be sold or transferred.
  • Don’t fake training. Don’t manipulate the timer, the app or our servers to create sessions, streaks or stats you didn’t earn.

5. LiftClub Pro

What’s free. Your streak, shields, workout logging, your full history, programs, friends, the feed and sharing are free. A free account can keep up to 5 workouts of its own. Workouts from LiftClub, and workouts you receive from others, don’t count toward that limit. Progress charts are free for Week and Month, and the Logs view is free for any time range.

What Pro adds. LiftClub Pro is an optional subscription. It adds:

  • unlimited workouts of your own;
  • Progress charts for Year, All and custom dates;
  • the Advanced charts (the muscle map and per-exercise progress);
  • LiftAI, if you’re 18 or over.

Plans and prices.

  • Monthly: US$14.99 a month.
  • Yearly: US$79.99 a year, with a 14-day free trial for eligible Apple IDs.
  • Local prices: the app shows the price in your currency before you buy. It can differ from the US price and include tax.

One-time offer. After onboarding, an eligible Apple ID may be offered its first year of the yearly plan at a discount (currently US$29.99, then US$79.99 a year).

  • The offer is available only for the time shown on screen.
  • It’s charged when you accept, and it has no free trial.

Billing.

  • Purchases are made through the Apple App Store.
  • Payment is charged to your Apple ID when you confirm the purchase, or when your free trial ends.
  • Your subscription renews automatically for the same period, at the then-current price, unless you cancel at least 24 hours before the current period ends.
  • Manage or cancel it in iPhone Settings → your name → Subscriptions, or in the app at Profile → Manage subscription.
  • If you allow notifications, we remind you two days before a free trial ends.
  • If you buy a subscription during a free trial, any unused part of the trial ends.

Cancelling. When you cancel, you keep Pro until the end of the period you’ve paid for. When Pro ends:

  • you keep all your workouts, and you can still start, edit and delete them;
  • you can’t create new workouts while you have 5 or more of your own;
  • Pro charts and LiftAI lock again.

Refunds. Apple handles payments and refunds under its own policies. We can’t issue refunds directly. To request one, go to reportaproblem.apple.com.

Deleting your account doesn’t cancel your subscription. Cancel it in Settings first.

Changes. We may change prices or what Pro includes. Apple tells you about price increases on an existing subscription and asks for your consent where the law requires it.

6. LiftAI

LiftAI is an optional Pro feature for people aged 18 or over.

  • Consent. It asks for your consent before it first reads your training. You can withdraw consent at any time in Profile → LiftAI.
  • What it does. It can build a workout, review your training, suggest what to train today and answer follow-up questions.
  • How it works. LiftAI’s answers come from a third-party AI model (currently Google’s Gemini), based on a summary of your training. The Privacy Policy explains exactly what’s sent.

Usage limits.

  • Allowance: 40 credits a month with Pro, 15 a month during a free trial, and no more than 10 a day.
  • Cost: most requests use 1 credit. A follow-up question uses 2.
  • Reset: credits reset at the start of each calendar month (UTC) and don’t carry over. They can’t be bought and have no cash value.
  • Automatic review: after you agree, the training review may run on its own, no more than once a week, and uses 1 credit when it does.
  • Pauses: LiftAI may pause for everyone until the next month if service-wide usage limits are reached.
  • Changes: we may change these limits.

Its output may be wrong. AI output can be inaccurate, incomplete or unsuitable for you.

  • LiftAI isn’t medical, physiotherapy or coaching advice, and it never tells you what weight to lift.
  • Check its suggestions before you act on them, and stop if something hurts.
  • Nothing LiftAI suggests is saved to your training until you tap to save or start it. You’re responsible for what you choose to do.

Using it responsibly.

  • Don’t try to make LiftAI produce harmful or unlawful content, or to extract its instructions.
  • Don’t use its output to build a competing service.
  • What you type into LiftAI is sent to our AI provider, so don’t include other people’s personal information.

7. Friends, posts and sharing

Friends features are for people aged 18 or over. When you choose a handle, you agree to the Community Guidelines. The Privacy Policy explains what friends and other people can see.

  • Posts. You can post up to 10 workouts a day, and a caption can be up to 140 characters. A share card attached to a post shows what’s on the card, which can include weights and personal bests if you leave them on.
  • Share links.
    • Who can see them: anyone who has the link, on a web page, with no LiftClub account needed.
    • What they show: a copy of the workout or program (names, exercises, sets, and reps or times). They never show the weights you lift, your notes or who shared it.
    • Expiry: links don’t expire. Stop sharing turns a link off, which can take a few minutes everywhere.
    • Copies: people who already saved the workout or program keep their copy.
  • Sending to a friend shows them your name and handle.
  • Exported share cards. An image you save, copy or share to Instagram or another app leaves LiftClub. We can’t delete it, and the other service’s terms apply.
  • Blocking and reporting. You can block or report people and content from the app.

8. Your content

“Your content” means what you put into LiftClub, including:

  • workouts, sets, notes, custom exercises and their instructions;
  • the names of workouts and programs;
  • your name, handle and profile photo;
  • posts, captions and share cards you post;
  • workouts or programs you share or send;
  • reports and feedback.

You own your content.

The licence you give us. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, display and send your content, only to run and improve the Service. For example, we use it to:

  • sync your data between your devices;
  • show your posts and summary to friends you’ve accepted;
  • show a share link to people you give it to;
  • deliver a workout to the friends you choose;
  • send a summary of your training to LiftAI when you ask it something.

When the licence ends. It ends when you delete the content or your account, except:

  • for copies already shared with others;
  • for copies in backups, which are kept for a limited time;
  • for reports, which we keep where we need them for safety.

Your responsibility. You confirm that you have the right to post your content, and that it follows these Terms and the Community Guidelines.

Moderation. We don’t review everything people post. We automatically block some words in names, captions and other text. We may refuse, remove or hide content that breaks these Terms.

Feedback. If you send us feedback, for example through Profile → Report an issue, we may use it without any obligation to you.

9. Acceptable use

Don’t:

  • break the law, or post anything the Community Guidelines don’t allow, such as harassment, hate, sexual content, threats, spam or impersonation;
  • post other people’s private information, or content you don’t have the right to share;
  • create accounts in bulk, with someone else’s details, or to get around a ban;
  • give a false birthday to get around an age limit;
  • fake training data, or tamper with streaks, stats, usage limits or Pro features;
  • access other people’s accounts or data, or probe, scan or get around our security or rate limits;
  • scrape the Service, or copy the exercise library or demonstration videos;
  • reverse engineer the app, except where the law allows it;
  • use the Service to build a competing product;
  • overload or interfere with the Service, or access it by automated means other than through the app;
  • misuse reports or blocking to harass someone.

We set usage limits, for example on sign-in codes per hour, friend requests, posts per day and how often you can make requests. Stay within them.

10. Moderation, suspension and ending your account

Reports and enforcement.

  • We review reports and aim to act on them within 24 hours.
  • We have zero tolerance for objectionable content and abusive users.
  • We may remove content, reset a name or handle, or suspend or permanently ban an account. A banned account can’t sign in.
  • We may also suspend access where we need to, to protect the Service or other people, or to comply with the law.

Bans and subscriptions. A suspension or ban doesn’t cancel an App Store subscription. Cancel it in Settings.

Deleting your account. You can delete your account at any time in Profile → Delete account, at the bottom of the page.

  • It takes effect immediately and can’t be undone.
  • It removes your account and the data tied to it from our servers, as the Privacy Policy describes.
  • It doesn’t cancel your App Store subscription.

Surviving terms. Sections 8 (as to content already shared), 11, 14, 15, 16, 19 and 20 survive the end of your account.

11. Our intellectual property

What’s ours. We or our licensors own the Service, including:

  • the app and website;
  • the LiftClub name and logo, and the mascot;
  • the exercise library and its instructions;
  • the exercise demonstration videos and images, including the characters Tom and Ashley;
  • workout artwork, built-in workouts and programs, and the design of the Service.

Your licence to use the app. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, as the App Store’s terms allow.

Open-source software. Some parts of the app are open-source software, used under their own licences.

Our brand. Don’t use the LiftClub name or logo without our permission.

12. Third-party services

The Service relies on, or links to, services we don’t control. Their own terms and privacy policies apply when you use them, and we aren’t responsible for them. They are:

  • Apple: the App Store and Sign in with Apple.
  • Google: Sign in with Google, and the AI model behind LiftAI.
  • RevenueCat: subscription status.
  • Instagram: sharing a card to your Story.
  • YouTube: the “Watch on YouTube” search on an exercise.

13. Availability and changes to the Service

  • Logging works offline. Syncing, friends features, share links, demonstration videos and LiftAI need a connection.
  • We may change, suspend or stop any part of the Service.
  • We don’t promise that the Service will always be available or free of errors.

14. Disclaimers

To the fullest extent the law allows:

  • the Service is provided “as is” and “as available”;
  • we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement;
  • we don’t warrant that workouts, programs, demonstrations, charts or LiftAI output are accurate, complete or suitable for you.

15. Limitation of liability

To the fullest extent the law allows:

  • No indirect losses. We aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for any lost data, profits or goodwill.
  • Injury from exercise. We aren’t liable for any injury from exercise you choose to do.
  • Cap. Our total liability for all claims about the Service is limited to the greater of:
    • what you paid for LiftClub Pro in the 12 months before the claim; or
    • CA$50.

Nothing in these Terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud. Nothing in them affects rights you have under consumer law that can’t be waived.

16. Indemnity

To the extent the law allows, you agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from:

  • your content;
  • your breach of these Terms; or
  • your misuse of the Service.

This doesn’t apply where the law prohibits it.

17. Terms that apply because you got the app from Apple

  • Who these Terms are with. These Terms are between you and LiftClub, not Apple. We, not Apple, are solely responsible for the app and its content.
  • Your licence. It’s limited to using the app on Apple-branded devices you own or control, as the App Store Terms of Service’s Usage Rules allow.
  • Support. Apple has no obligation to provide maintenance or support for the app.
  • Warranty. If the app fails to conform to any warranty that applies, you can notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • Claims about the app. We, not Apple, are responsible for addressing any claims about the app. That includes:
    • product liability claims;
    • claims that the app fails to meet legal or regulatory requirements;
    • claims under consumer protection, privacy or similar laws;
    • claims that the app infringes someone’s intellectual property. If anyone makes such a claim, we, not Apple, are responsible for investigating, defending, settling and discharging it.
  • Your eligibility. You confirm that you aren’t located in a country subject to a US Government embargo, or designated by the US Government as a “terrorist supporting” country, and that you aren’t on any US Government list of prohibited or restricted parties.
  • Other services’ terms. You must comply with any third-party terms that apply when you use the app.
  • Third-party beneficiaries. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you.
  • Questions and claims. Send questions, complaints or claims about the app to the contact details in section 21.

18. Changes to these Terms

We may update these Terms. If a change is material, we’ll tell you in the app or by email before it takes effect, and we’ll update the date at the top. If you keep using the Service after the change takes effect, you accept the updated Terms. If you don’t agree, stop using the Service and delete your account.

19. Governing law and disputes

These Terms are governed by the laws of the Province of [TO CONFIRM: province] and the federal laws of Canada that apply there, without regard to conflict-of-law rules.

If you have a dispute with us, please contact us first so we can try to resolve it informally. If we can’t, the courts of the Province of [TO CONFIRM: province] have jurisdiction. Nothing in this section takes away consumer protections that apply where you live, including your right to bring a claim in your local courts.

20. General

  • Entire agreement. These Terms, the Privacy Policy and the Community Guidelines are the whole agreement between you and us about the Service.
  • Severability. If any part of these Terms is found unenforceable, the rest still applies.
  • No waiver. If we don’t enforce a right, we haven’t waived it.
  • Transfer. We may transfer these Terms as part of a reorganisation or a sale of LiftClub. You may not transfer them without our consent.
